Pakistan Telecommunication (Re-organization) Act, 1996
Summary
This 1996 Act reorganized Pakistan's telecommunications sector, moving it from a single state corporation to a licensed, regulated industry. Section 3 establishes the Pakistan Telecommunication Authority (PTA) as the sector regulator, with its functions in Section 4, powers in Section 5, and an appeal mechanism through a dedicated Tribunal (Section 7A) and onward appeal to the Supreme Court (Section 7B). Section 8 lets the Federal Government issue policy directives to PTA.
Chapter III sets out the licensing regime: Section 20 covers licensing of telecom services, Section 21 gives PTA the exclusive power to grant licences, Section 22 covers modifying licence conditions, and Section 23 covers enforcement orders and penalties (with fines credited to the Federal Consolidated Fund under Section 23A). Section 26 covers tariffs, Section 27A (added by later amendment) covers "Right of Way" for laying telecom infrastructure, and Section 31 covers offences and penalties more broadly, backed by search-warrant powers in Section 32.
Chapter IIIA, added later, creates two special funds: the Universal Service Fund (USF, Sections 33A-33B), meant to extend telecom access, and a Research and Development Fund (Sections 33C-33D).
Chapter IV converted the old state Corporation into Pakistan Telecommunication Company Limited (PTCL): Section 34 establishes the Company, Section 35 vests the former Corporation's rights, property, and liabilities in the new entities, and Section 36 covers terms and conditions of service for transferred employees. Chapter V creates the National Telecommunication Corporation (Section 41), Chapter VI creates the Frequency Allocation Board and its powers (Sections 42-43), and Chapter VII creates the Pakistan Telecommunication Employees Trust, including a Pension Fund (Section 45), to look after transferred employees' retirement benefits.
Section 58 makes this Act override the older Telegraph Act, 1885 and Wireless Telegraphy Act, 1933 wherever they conflict, and Section 59 repeals the Pakistan Telecommunication Corporation Act, 1991 and the earlier reorganization ordinances that preceded this Act.
