Pakistan Railways Police Act, 1977
Summary
This Act establishes the Pakistan Railways Police, a dedicated federal police force for the railway system, separate from provincial police forces. Section 3 lists its functions: preventing loss to railway property and property being transported by rail, ensuring proper conduct of people on the railways, general maintenance of law and order and taking cognizance of offences on the railways, assisting passengers and railway employees, protecting travellers from harm, keeping platforms clear of "idlers and beggars" while watching for smugglers and unlicensed weapons, recovering lost property left in carriages, and regulating vehicle movement and parking at railway stations.
Section 4 places the force under an Inspector-General, who administers it under the general supervision of the Chief Executive of Pakistan Railways. Section 5 transferred existing provincial Railway Police personnel (up to the rank of Superintendent) and Railway Watch and Ward staff into the new federal force, subject to conditions the Federal Government could lay down. Section 6 exempts the force from the Industrial Relations Ordinance, 1969, meaning its members are not covered by that law's union and labour-relations framework.
Section 9 gives officers and members of the force the same investigative, arrest, and prosecutorial powers as ordinary police under the Police Act, 1861, and the Code of Criminal Procedure, plus a specific power to pursue a fleeing suspect into any place in Pakistan immediately after an offence is committed. Section 10 lets the Federal Government appoint special Magistrates and Public Prosecutors specifically for railway police cases. Section 11 makes officers and members liable to departmental action or, on conviction before a Magistrate, imprisonment up to six months or a fine up to one thousand rupees, or both, for misconduct such as disobeying lawful orders, cowardice, unauthorised absence, or unauthorised outside employment; a convicted person can appeal to the Court of Session within thirty days. Section 12 gives officers and members indemnity from suits or prosecution for acts done in good faith under the Act, and Section 13 makes every officer and member a "public servant" under the Pakistan Penal Code.
The First and Second Schedules set out the standard oath of allegiance new officers and members must sign, and the form of the identity certificate issued to them.
