National Commission For Human Development Ordinance, 2002
Summary
This 2002 Ordinance creates the National Commission for Human Development (NCHD), a government body set up to work with NGOs and philanthropists on social-sector programs such as primary education, literacy, income-generating activities and basic health care at the district level. Section 3 establishes the Commission as a body corporate (it can own property, sign contracts, and sue or be sued in its own name), based in Islamabad, functioning as an autonomous body under the Cabinet Division, with the President as its Patron-in-Chief.
Section 4 and 5 set up the Commission's leadership: a Chairman appointed by the President for a five-year term who also acts as Chief Executive Officer, and five Members (including a Finance Ministry representative) appointed on the Chairman's recommendation, with the Ordinance requiring provincial representation and gender equality among the Members. Section 7 lists the Commission's core functions: capacity building for government and NGO staff, literacy and skills-training programs, support for universal primary education and primary health care, poverty alleviation efforts, and a national volunteer program.
Section 8 lets the Commission issue Policy Guidelines covering poverty alleviation, basic education, primary health care, sustainable livelihoods and capacity building, informed by an Advisory Council (Section 9) made up of representatives from federal ministries, provincial governments and civil society, which meets at least quarterly. Section 10 creates a Director-General as the Commission's chief administrative officer.
Funding comes from the Pakistan Human Development Fund, a company registered under the Companies Ordinance 1984 (Section 14), and Sections 15 and 17 govern how that money is spent and audited by a firm of Chartered Accountants. Section 22 grants the Commission, its Chairman, Members and staff immunity from lawsuits for anything done in good faith under the Ordinance. As an ordinance from 2002 that has not been shown to be repealed in the extract, its current legal status and whether it has since been amended should be verified against the official record.
