Summary

This 1982 ordinance establishes the Korangi Fisheries Harbour Authority to plan, build, operate, and maintain a fisheries harbour within the limits of Port Qasim, aimed at helping Pakistan exploit fisheries resources beyond its territorial waters. Section 3 lets the Federal Government define and later alter the exact geographic limits of the harbour by official notification.

Section 4 establishes the Authority as a body corporate that can own property and sue or be sued, and Section 5 places its general management in a Board that must follow sound fisheries harbour planning principles while being guided by Federal Government policy directions. Section 6 sets out the Board's composition — between seven and eleven members including a government-appointed Chairman, the Managing Director, a representative of the Sindh government, provincial and federal Fisheries Department directors, and nominees from the Fish Processors' Association and local fishermen's associations. Members (other than ex-officio ones) serve three-year terms and can be reappointed.

Section 9 lists the Authority's wide powers, including acquiring land within the harbour area, entering contracts, planning and supervising harbour construction, operating and maintaining harbour facilities to safety and hygiene standards, regulating traffic and security within the harbour, and disposing of property, though disposing of immovable property requires prior Federal Government approval. Section 29 specifically allows the Authority to lease, sell, exchange, or rent land vested in it.

Section 30 lets the Authority make rules and regulations with the Federal Government's prior approval, while Section 31 keeps all its acts subject to Federal Government control, which can suspend or modify any Board decision. Section 32 provides a mechanism for the Federal Government to dissolve the Authority entirely by notification, in which case its properties, funds, and liabilities transfer to the government or an agency it designates. Section 33 lets the government resolve any conflicts or difficulties in applying this ordinance, including overlaps with the Port Qasim Authority Act, 1973.
