Summary
This 1984 Ordinance regulates real estate agents and motor vehicle dealers operating within the Islamabad Capital Territory. Section 3 makes it illegal to run either business without being registered and holding a valid certificate from the registering authority (the District Excise and Taxation Officer, Islamabad, or someone authorised in that role), though agents already operating when the law commenced had a grace period to apply.
Section 4 disqualifies certain people from registration: minors, those found of unsound mind by a court, declared insolvents, and anyone convicted of offences like misappropriation, breach of trust, cheating or other morally serious crimes, unless three years have passed since their release. Section 5 sets out the application process, with a registration fee capped at two thousand rupees, and section 6 requires renewal every year, at a fee capped at one thousand rupees, with smaller penalty fees for late renewal.
Section 7 lets the Federal Government fix the maximum commission an agent or dealer can charge on a transaction. Section 8 requires agents and dealers to keep proper accounts and records and produce them on demand, and section 9 gives the registering authority or an authorised Inspector power to enter and inspect business premises and books, with a fine up to two thousand rupees for obstructing this.
Section 10 allows registration to be cancelled or suspended — for up to three months, or six months on a repeat breach — for things like keeping false accounts, dealing in property with a known title defect, or overcharging commission, though the agent must first get seven days' notice and can appeal to the Administrator of Islamabad Capital Territory. Section 11 sets the general penalty for violating the Ordinance at simple imprisonment up to six months or a fine up to five thousand rupees, or both, with prosecutions only allowed on a written complaint from the registering authority.
