Government Buildings Act,1899

The Government Buildings Act, 1899 is a short, technical law that frees certain government-owned buildings from having to follow ordinary municipal building rules. Normally, if you want to construct, alter, or repair a building inside a municipality, you need to follow the local municipal authority's building bye-laws. This Act says those rules do not apply to buildings that are used for public service, or which belong to or are occupied by the Government.

Section 2 defines "municipal authority" to include a municipal corporation or any body of municipal commissioners set up under law. Section 3 is the core exemption: government buildings, or land the Government occupies for erecting such buildings, are excluded from municipal construction laws. The one exception is that, before starting or materially altering such a building, the Government must give the municipal authority reasonable notice — unless the building is connected with defence, or its plans are treated as confidential or secret, in which case even that notice requirement falls away.

Section 4 sets out a limited check on this exemption. The municipal authority, only with the Provincial Government's prior permission, can inspect the land, building, and plans, and submit written objections or suggestions about the proposed construction. The Provincial Government then considers these and issues binding orders on how the building should proceed. If it overrules the municipal authority's objections, it must record its reasons in writing.

This is a very old law (1899) that has been repeatedly amended — its footnotes show substitutions and omissions going back to 1937, 1949, 1960, and 1961, including changes to reflect Pakistan's independence and later constitutional terminology. Anyone relying on it for a specific construction dispute should check the current official text, since terms like "Government" and "Provincial Government" have been redefined multiple times.
